By accessing or using the Sendryx platform ("Service"), you agree to be bound by these Terms of Service. The Service is operated by Sendryx, UK ("Sendryx", "we", "us"). If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these terms.
Sendryx provides a WhatsApp Business messaging platform that enables businesses to send automated and manual WhatsApp messages to opted-in customers via the Meta WhatsApp Business API. The Service includes campaign management, contact database management, opt-in consent tracking, message delivery logging and reporting.
You must be at least 18 years old and a registered business to use the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when registering and keep your account information up to date.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not: • Send messages to recipients who have not provided explicit opt-in consent • Send spam, unsolicited bulk messages, or deceptive content • Use the Service to harass, abuse, or harm any person • Violate Meta's WhatsApp Business Policy or Commerce Policy • Attempt to reverse engineer, hack, or disrupt the Service • Resell or sublicense the Service without written permission • Use the Service for any illegal purpose or in violation of any applicable law
You are solely responsible for ensuring your use of the Service complies with Meta's WhatsApp Business Policy, including obtaining valid opt-in consent from all message recipients before sending any messages. You acknowledge that Meta may suspend or terminate WhatsApp Business API access at any time and that Sendryx has no control over Meta's decisions. Sendryx is not liable for any loss arising from Meta's actions.
You retain ownership of your business data and customer data. By using the Service, you grant Sendryx a limited licence to process this data solely for the purpose of delivering the Service. You are the data controller for your customers' personal data. Sendryx acts as a data processor on your behalf. You must have a valid legal basis to process your customers' data and must comply with all applicable data protection laws including UK GDPR. Paid plans are billed monthly in advance. All fees are in GBP and exclusive of VAT where applicable. Failure to pay may result in suspension of your account. In addition to Sendryx subscription fees, Meta charges per-message fees for WhatsApp Business API usage. These fees are charged directly by Meta and are separate from Sendryx subscription fees. Refunds are not provided for partial months of service.
Where a free trial is offered, no payment is required during the trial period. At the end of the trial, access will be suspended unless you subscribe to a paid plan. We do not require a credit card to start a free trial.
The Sendryx platform, including all software, design, trademarks and content, is owned by Sendryx and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your business purposes during the term of your subscription. Your data and any content you create remains your property.
We aim to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. Support is provided via email at hello@sendryx.cloud. We aim to respond to support requests within one business day.
To the maximum extent permitted by law, Sendryx shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or business opportunities, arising from your use of or inability to use the Service. Our total liability to you for any claims arising under these Terms shall not exceed the total fees paid by you in the three months preceding the claim.
Either party may terminate the agreement with 30 days written notice. We may suspend or terminate your account immediately for breach of these Terms, non-payment, or at Meta's request. Upon termination, your access to the Service will cease and your data will be deleted within 30 days unless you request an export.
We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
